GENERAL BOOKING TERMS AND CONDITIONS FOR ACCOMMODATIONS AND ACTIVITIES
ARRANGED AND / OR MEDIATED BY
BY NORDIQ AB

These general terms and conditions apply to booking of accommodations/activities mediated by By Nordiq AB (BN AB), org nr 556669-6125, Box 163, 271 24 Ystad, in conjunction with the event Vansbrosimningen arranged by Vansbro AIK Simklubb. BN AB reserves the right to unilaterally change these general booking terms and conditions. Any changes will take effect no sooner than 30 days after the new and updated terms and conditions have been published on the Booking Portal website. BN AB mediates bookings of accommodations in hotels, holiday villages, B & B and similar as well as private accommodations in conjunction with Vansbro AIK Simklubb events.

PACKAGES
In the event that any form of accommodation or acitivities is booked together on www.vansbrosimningen.se or in connection with booking competition participation, your booking will be considered a package trip or linked travel arrangement. Organizer or responsible trader is By Nordiq AB, Hamntorget 2 i Ystad, tfn 0411-558725, support@bynordiq.se. By Nordiq AB has placed a travel guarantee with Kammarkollegiet.

If you book additional travel services for your trip or vacation via this link/links no later than 24 hours after receipt of your booking confirmation from our company BN AB these travel services will however constitute a part of a linked travel arrangement. In that case BN AB has, in accordance with EU regulations, a refund insurance for services that cannot be carried out in case of insolvency on the part of BN AB. Note that this does not mean any refunds if the service provider should become insolvent.

1. WHEN DOES THE BOOKING OF ACCOMMODATIONS OR ACTIVITIES BECOME BINDING?

1.1 By booking accommodations/activities through the Booking Portal you, the Booker, agrees to these, currently valid, terms and conditions. These terms and conditions apply from that moment regardless of whether you have paid the entry fees in their entirety, partially, or not at all. Therefore, make sure to carefully read these terms and conditions before booking. Booking of accommodations/activities is binding for the Booker.

1.2 In the cases when the Booker makes reservations of accommodations on behalf of another person or persons, then by virtue of approval of these terms and conditions, the Booker insures that the person or persons in question has been informed of these terms and conditions that become binding for them when the application/booking is made.

1.3 In cases where bookings are made on behalf of a child under 18 years of age, the Booker must first receive consent from the child’s parent or legal guardian.

1.4 Bookings are not subject to cancellations, changes, or refunds, unless specified in these terms and conditions for the product or service in question. Booking of accommodations/activities is binding and thus no refunds will be made.

1.5 BN AB reserves the right to transfer our rights and obligations according to these terms and conditions to a third party.

2. HOW AND WHEN SHALL PAYMENT BE MADE?

2.1 Bookings should be pre-paid with a credit/debit card (VISA/Mastercard) or through a bank transfer or invoice (payment due within 14 days). Payments are made to By Nordiq AB since they mediate and manage bookings and payments for rentors, hotels and providers of other accommodations as well as private rentors and activities. Payment instructions can be found on the booking portal. After June 1st of the year of the event the only acceptable payment method will be with a credit/debit card (VISA/Mastercard). Note that bookings made by email take 1-2 days to process. The right to use mediated accommodations/activities upon full receipt of payment.

2.2 After reservation/booking of accommodations and payment in full have been made you will receive a booking confirmation to the email address you have supplied. Make sure that the information in the confirmation is correct. If you still haven’t received a confirmation 24 hours after booking or if any of the information is incorrect we ask that you contact us at vansbrosimningen@bynordiq.se or by phone +46 (0)411 55 87 00

3. PAYMENT OVER THE INTERNET

3.1 In order to protect and encrypt the Booker’s credit card information, the Booking portal uses a Secure Socket Layer (SSL) encrypted connection.

4. WHAT HAPPENS AT NON-PAYMENT?

4.1 BN AB reserve the right to remove bookings that have not been paid for in time.

5. WHAT APPLIES FOR GROUP BOOKINGS (FOR MORE THAN 9 PEOPLE)?

5.1 If no other agreement has been made, the Booker must, no later than 4 weeks before arrival, provide specific information about the number of group members and the names of those who will be staying in the rooms.

6. WHAT APPLIES TO CANCELLATIONS?

6.1 Bookings of mediated accommodations and activities are binding (bus ticket is binding after 1st of May) and cannot be cancelled by the Booker. Payment will not be refunded.

6.2 Strike, lockout, fire, flooding or other natural disaster, accidents, blockade, war, government action/decision, new or changed laws, restrictions on deliveries or other extraordinary circumstances beyond the control of the accommodation or activity provider entitles BN AB and the accommodation and activity provider to cancel the contract/booking without being liable to pay compensation of any kind.

6.3 A booking of mediated accommodations and activities (bus ticket is binding after 1st of May) in conjunction with Vansbro AIK Simklubb events is non-refundable. Illness or injury might make you eligible for compensation from your insurance company or cancellation insurance. Contact your insurance company to request compensation. See below for cancellation insurance.

7. SPECIFIC TERMS FOR PRIVATE RENTAL ACCOMMODATIONS

7.1 BN AB mediates private rental accommodations as agent. The rental agreement mediated by BN AB is between you as rentee and the owner of the property as rentor. After booking and payment you will get an e-mail confirmation from the agent BN AB. With the confirmation you will also receive a voucher/document with additional information.

7.2 Booking is based on the object description that is based on information from the rentor. Rules about cleaning and bed linen is provided in the information from the rentor or agreed upon mutually between rentee and rentor. The following rental terms are part of the rental agreement entered, with BN AB as agent, between the rentor and rentee at booking:

7.2.1 The rental property must not be used as accommodation by more guests than the maximum number of beds specified by the rentor, unless otherwise agreed. The rentee does not have the right to set up tents or caravans on the property. The rentor does have the right to evict the extra persons and no refund will be made.

7.2.2 If there is no information about bed linen or cleaning in the information from the rentor the general rule is that the rentee is responsible for this and that it is not included in the rental price.

7.2.3 If nothing else is specified in the information from the rentor the object will be available from 15.00 on the day of the arrival and the time for checkout is no later than 11.00. The rentee and rentor are responsible for arranging to get and return keys.

7.2.4 If the rentor has specified that pets are now allowed the rentee does not have the right to bring pets. Even if the rentor has specified that pets are not allowed that does not constitute a guarantee that there has never been pets there before or that the rentor does not have pets.

7.2.5 Smoking is generally not allowed in the rental objects unless the object description specifically says that smoking is allowed. This must be agreed upon separately between rentee and rentor.

7.2.6 If boat is included in the rental object the rentee is responsible for checking the equipment as well as making sure that any driving certificates or similar as required by law are available when using the boat. Neither rentor nor agent can be held responsible for any loud noise from traffic, machinery or similar.

7.2.7 Neither rentor nor agent can be held responsible for the quality of the internet connection, like poor coverage or low speed.

7.2.8 The rentee is responsible for the use of pools, spa baths and similar, and responsible for following rules when using same.

7.2.9 Note that rental object bookings can be cancelled by agent or rentor if there is a proper reason for it, such as fire, flooding, or technical problems or if the property has been sold. The agent cannot be held responsible in these cases. The agent can only try to help with finding a similar object as soon as possible.

7.2.10 Equipment and movables shall be handled with respect. Read more in the voucher information.

7.2.11 The rental objects shall be in good order at arrival. Complaints regarding cleaning should be made immediately to the rentor. Should the rentee find deficiencies or damage on arrival the rentor and agent must be informed immediately (within 72 hours). Otherwise the rentee forfeits any rights to compensation. The rentor and/or agent have the right to try to rectify any problems within a reasonable time. Departure from the rental object before the end of the rental period is made at own cost and risk of the rentee. The rentee risks not being able to make demands. The rentee is then considered to have made any solutions to the complaint impossible.  The agent reserves the right to move the rentee to a different rental object to rectify any problems.

7.2.12 On departure the object should be left in the same condition as it was on arrival. The rentee is liable for any serious faults or damage caused by the rentee.

8.SPECIFIC TERMS FOR ACTIVITIES

8.1 Bus tickets are cancelable and refundable against an administrative fee corresponding to 25% of the booking price until May 1, however a minimum of SEK 150, after which the bus ticket is not cancelable or refundable.

8.2 BN AB mediates private rental accommodations/activities as agent. The rental/activity agreement mediated by BN AB is between you and BN AB. After booking and payment you will get an e-mail confirmation from the agent BN AB.

8.3 With the proviso that bus trips can be changed and/or canceled if fewer than 25 seats are booked, the customer receives a 100% refund of the booked bus trip. Changes to bus tours are announced no later than 4 days before the first bus journey of all Vansbrosimningen's bus tours (that competition year) that are booked through By Nordiq.

9. WHAT APPLIES IF VANSBROSIMMNINGEN MUST CANCEL OR POSTPONE THE COMPETITION?

9.1 Vansbro AIK Simklubb reserves the right to cancel or postpone the Vansbro AIK Simklubb event Vansbrosimningen in its entirety as well the right to cancel or postpone one or more competitions or change routes and/or start times

9.1.1 due to circumstances beyond the control of Vansbro AIK Simklubb, including but not limited to government action or negligence, new or changed laws, labour conflicts, blockade, fire, flooding, other natural disasters, or major accidents or

9.1.2 if Vansbro AIK Simklubb or the authorities consider it necessary for the safety or health of you and/or other participants or

9.1.3 If Vansbro AIK Simklubb is denied the government permits needed to successfully arrange the competitions.

9.2  This also applies to bookings of accommodations and activities.

9.3 BN AB reserves the right, in case Vansbro AIK Simklubb cancels or postpones Vansbro AIK Simklubbs Vansbrosimningen event in its entirety, part thereof or cancels or postpones one or more competitions or changes routes or start times, to cancel or move accommodations/activities.

9.4 BN AB is not liable to refund any fees or pay damages or other compensation if the entire Vansbro AIK Simklubbs Vansbrosimningen event or one or more competitions must be cancelled or postponed or in case BN AB must cancel or move accommodations/activities due to changes according to paragraphs 9.1.1-9.1.4 as specified above or any other extraordinary circumstances.

9.5 In case of cancelled or postponed Vansbro AIK Simklubb events no demands for refunds can be made to By Nordiq AB for private rental accommodations or activity products mediated by By Nordiq AB as agent.

10. TERMS AND CONDITIONS FOR COMPLAINTS

10.1 Any complaints regarding a purchased or booked product or service must be submitted to the accommodation/activity provider as soon as possible. Contact BN AB if the problem is not rectified.

10.3 The right to any potential compensation is forfeited unless the accommodation provider/activity provider or their representative is informed of the problem on site and given reasonable time and opportunity to resolve the issue at hand. Any claims and requests for compensation should first be addressed to the accommodation provider/activity provider and after that to BN AB in writing no later than August 31st of the year of the event.

 

11. PERSONAL INFORMATION

11.1 BN AB is responsible for the personal information that is collected in conjunction with the booking of mediated accommodations/activities. By Nordiq AB (BN AB) is also responsible for the personal information that is collected for private accommodations/activities.

11.2 BN AB collect and handle personal information that you provide BN AB with.  Personal information that will be handled include, but is not limited to, name, birth date, gender, address, e-mail address and phone number. We might also handle information registered in conjunction with a booking, such as age and special dietary requests.

11.3 The purpose of handling personal information.

11.3.1 BN AB will process personal information about individuals for whom bookings are made to be able to fulfil our obligations to the Booker and other participants regarding bookings of camping sites and other accommodations. Personal information might also be used by BN AB to fulfil its legal obligations, including those related to security.

11.3.3 Note that you can refuse to provide personal information. But is often not possible for BN AB us to provide you with the product and/or service you have ordered unless you provide your personal information.

11.3.4 Your personal information might also be handled so that BN AB can fulfil obligations according to accountancy laws and other legal obligations, including those related to security. Handling might also include information about communication between you and BN, including questions and complaints.

11.3.5 Your personal information might also be used for our market and client analysis, risk management and statistics, to give you better travel offers and service. Unless you object to it in writing BN AB can also use your personal information to provide offers about services and/or products from BN AB. You have the right to decline to receive further offers.

Storing personal information

12.4 Personal information will be stored for bookkeeping reasons for a period of seven (7) years. If consent is given to follow up and develop BN AB in the subsequent years, then personal details will be saved for five (5) years. Providing consent to newsletter as a subscription until consent is withdrawn.

Who might handle your personal information?

12.6 Employees of BN AB as well as by partners of the BN-concern within the tourism business, for example hotels, holiday villages, B&B’s and local cooperation partners as well as suppliers of administrative and systems services to the BN-concern.

12.7 Personal information will not be provided to a third country. A Booker whose personal details have been collected has the right to request information about which of his or her personal details Vansbro AIK Simklubb and BN AB have in their possession.

12.8 The Booker also has the right to request a correction of incorrect personal details and the right to request a deletion of personal details. The Booker has the right to block and oppose the use of personal details.

12.9 For Vansbro AIK Simklubb and BN AB to fulfil its obligations related to a valid contract related to Vansbro AIK Simklubbs Vansbrosimningen participation or other booked product/service the participants’ personal details need to be processed.

12.10 If the Booker blocks Vansbro AIK Simklubb and BN AB from using his or her personal data in such a way that Vansbro AIK Simklubb and BN AB can no longer fulfil its contractual obligations to the Booker, then no refund will be issued.

12.11 The Booker has the right to submit a complaint to the overseeing authority, Integritetsskyddsmyndigheten.
